Section 64 prescribed as follows:
After the Union has entered into International Convention of Trademark Registration system, the international application either designating to Myanmar or filed from Myanmar shall be entitled to file in accordance with the stipulations. Filing Trademark Assignment, Trademark Licensing and Geographical are also available under this Trademark Law (2019).
Trademark Forms
According to the Notification no. 1/2023 April 1, 2023 issued by IP Agency , the required documents and official fees are as follows:
TM-1: examination of acceptance of trademark registration application: MMK150,000
TM-2: The appointment of representative: no fees
TM-3: review of reinstatement of an application due to failure of prescribed rules: MM K100,000
TM-4: amendment of request for correction of error in an application: MMK50,000
TM-5: Request for withdraw of trademark application : no fees
TM-6: request to limit the list of goods/services in an application: MMK50,000
TM-7: request to divide an application for registration: MMK100,000
TM-8: application to oppose a trademark application: MMK150,000
- Request for the recordation of trademark registration: MM K150,000
TM-9: request for certified copy of registration certificate: MMK50,000
TM-10: request for amendment of registration of a trademark: MMK50,000
TM-11: application for renewal of trademark registration: MM K300,000
TM-12: application to register a transfer of ownership: MMK100,000
TM-13: application to register a license of trademark: MM K100,000
TM-14: Request for cancellation of recordal of trademark license: no fees
TM-15: application for invalidation of a registered trademark: MM K150,000
TM-16: application for cancellation of a registered trademark: MM K100.000
TM-17: request for change of representative or agent: MMK20,000
TM-18: request for extension of time:MMK50,000
TM-19: application for appeal:MMK500,000
-The fees of TM-1, TM-11 TM-19 and request for recordation of Registration are only for one class or services.
-The fees of TM-12 and TM-13 are only for one trademark.
-The fees of TM-3, TM-4, TM-6, TM-7, TM-8, TM-9, TM-10, TM-15, TM-16, TM-17 and TM-18 are only for one application.
